Cooper & Oxley - What should subcontractors do now?

It could be a while before subcontractors will get paid (if at all) and you should consider how this will impact on your ability to continue to trade. Consider whether your personal assets are at risk (if you have given personal guarantees) and consider your risk of insolvent trading, if you don’t get paid.

You should get advice on the prospects of getting paid for invoices already issued and the issuing of invoice for other work already completed.

NECA Legal can assist with preparation of Applications for Adjudication of Payment Disputes under the Construction Contracts Act . Note that in accordance with the Corporations Act, all proceedings against a company are stayed once the company is formally placed under administration.
